Inspired Go provides specialized meal delivery services tailored to regional markets through its separate legal entities: Inspired Go Inc. for deliveries within Canada, and Inspired Go USA Inc. for deliveries within the United States. Each entity operates independently, adhering to its regional operational standards and legal requirements. By accessing or using our services, you agree to comply with and be bound by the following terms and conditions, applicable according to the entity serving your region. Please review these terms carefully.
ACCEPTANCE OF AGREEMENT
By accessing or using our site and services, you agree to the terms and conditions outlined in this Agreement. This Agreement constitutes the entire and only agreement between you and the applicable Inspired Go entity (either Inspired Go Inc. or Inspired Go USA Inc.), and supersedes all prior or contemporaneous agreements, representations, warranties, and understandings with respect to the site, content, products, or services provided by or through the site.
SUBSCRIPTIONS
By subscribing to our Subscribe & Save service, you agree to the following terms:
1. Weekly or Biweekly Charges: You authorize Inspired Go Inc. (for Canadian customers) or Inspired Go USA Inc. (for U.S. customers), or a third-party payment processor, to charge your credit card for:
• A minimum weekly or biweekly fee, determined by your initial order selection when creating your subscription.
• A Delivery Fee, if applicable to your order, based on our pricing model (e.g., $6.95 for orders under $61).
2. Continued Authorization: You authorize us to charge your credit card for these amounts until you decide to cancel, skip, or pause your subscription.
3. Adjustment Deadlines: To skip, pause, or cancel your subscription, you must make these adjustments through your account or via live chat assistance prior to your order’s cut-off time:
• Sunday deliveries: Adjustments must be made by Wednesday before 3:59 PM MST.
• Monday deliveries: Adjustments must be made by Thursday before 3:59 PM MST.
• Tuesday deliveries: Adjustments must be made by Friday before 3:59 PM MST.
Failure to make adjustments before the specified cutoff times will result in your payment being processed for your order, and you will receive your order as scheduled.
4. Notification of Changes: When you sign up for Subscribe & Save, you acknowledge and agree that you will be charged on a weekly or biweekly basis based on the items included in your subscription order. We will not add or remove items without notifying you through the email address associated with your account. To ensure you receive these important notifications, please add our email address to your address book to prevent emails from being filtered into your junk/promotional folder.
HEALTH AND ALLERGY DISCLAIMER
Our meals are prepared in facilities that handle common allergens. While we take precautions to minimize risk, we cannot guarantee that cross-contamination will not occur. Please consider your health needs when ordering.
PRODUCT DESCRIPTION AND ACCURACY
We strive to ensure that all details, descriptions, and prices of products appearing on the website are accurate at the time the relevant information was entered into the system. However, to the extent permitted by applicable law, we do not warrant that the product descriptions, colors, information, or other content available on the site are accurate, complete, reliable, current, or error-free. Information on the site may occasionally contain typographical errors, inaccuracies, or omissions that may relate to product descriptions, pricing, promotions, offers, and availability. The services provided under these terms are governed by the laws applicable to the entity serving your region:
For Canada: The laws of Canada and the Province of Alberta govern services provided by Inspired Go Inc.
For the United States: The laws of the State of Delaware govern services provided by Inspired Go USA Inc.
Any legal actions or proceedings arising out of or relating to these terms shall be brought exclusively in the courts of the respective jurisdiction.
LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, in no event shall Inspired Go Inc. or Inspired Go USA Inc., as applicable, be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:
• Your access to or use of or inability to access or use the services;
• Any conduct or content of any third party on the services;
• Any content obtained from the services; and
• Unauthorized access, use, or alteration of your transmissions or content.
In no event shall the total liability of Inspired Go Inc. or Inspired Go USA Inc., as applicable, for all damages, losses, and causes of action exceed the amount paid by you, if any, for accessing this site or purchasing products.
If you are dissatisfied with any portion of the service, or with any of these terms, your sole and exclusive remedy is to discontinue using the service and the products.
ENTITY-SPECIFIC LIABILITY
Inspired Go operates through two distinct and legally separate entities:
Inspired Go Inc. is responsible exclusively for deliveries and operations within Canada. Any legal actions or claims arising from operations in Canada must be addressed solely to Inspired Go Inc. and are governed by the laws of Canada and the Province of Alberta.
Inspired Go USA Inc. manages all operations and deliveries within the United States. Any legal actions or claims arising from operations in the United States must be addressed solely to Inspired Go USA Inc. and are governed by the laws of the State of Delaware.
Each entity operates independently and is not responsible for the obligations, debts, or actions of the other. Customers and third parties are prohibited from seeking legal remedies from one entity for the liabilities or operational issues of the other.
INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Inspired Go Inc. or Inspired Go USA Inc., as applicable, and their respective directors, officers, employees, consultants, agents, and affiliates, from any and all third-party claims, liability, damages, and costs (including, but not limited to, legal fees) arising from your use of our services, your violation of these terms, or your infringement of any intellectual property or other right of any person or entity.
MODIFICATIONS TO THE TERMS
We reserve the right to modify, add, alter, or remove these terms and conditions at any time. These changes are made to accommodate shifts in market conditions impacting our business, advancements in technology, and adjustments in legal and regulatory requirements.
When you make a purchase from Inspired Go, you are bound by the policies and terms and conditions that are in effect at the time of your purchase. However, any alterations to these policies and terms and conditions that are mandated by law or government authority will supersede the previously established terms.
We are committed to ensuring that our terms and conditions remain in alignment with the evolving landscape of our industry, technology, and legal obligations while providing you with transparent and reliable service.
SEVERABILITY
If any provision of these terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced to the fullest extent under law.
FORCE MAJEURE
We shall not be liable for any failure to perform our obligations under these terms where such failure results from any cause beyond our reasonable control, including but not limited to acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, or strikes.
ENTIRE AGREEMENT
These terms constitute the entire agreement between you and Inspired Go Inc. or Inspired Go USA Inc., as applicable, regarding the use of our services and supersede any prior agreements between you and us relating to your use of the services.
